1. Who we are and scope

Xheki is provided by MIK Group GmbH, Leutschenbachstrasse 95, 8050 Zürich, Switzerland, registered in the commercial register of the Canton of Zurich under CH-440.4.024.833-4, VAT ID CHE-188.366.328 ("we", "us").

These terms apply to the Xheki iPhone app and the online services it uses. By creating an account or using the app you agree to them. Your licence to the app itself also follows Apple's Licensed Application End User License Agreement (the "Apple EULA"); section 15 lists the App Store terms that always apply. How we handle personal data is explained in our Privacy Policy.

2. The service

Xheki lets you record videos (selfie, front and back camera, or your face over a screen recording), edit them, generate captions — built first for Albanian, with automatic captions in other supported languages — style and burn the captions into the video, export it, and get AI-written post text and thumbnails. Albanian is transcribed by a speech-recognition service built for Albanian; other languages, and the AI text and image features, by OpenAI. Premium includes a search for free stock photos from Pexels. We pass your requests to them (see section 11).

3. Your account

• You sign in with Apple. Recording, editing, export and Premium work without an account; credits, the AI features and the picture search need one.
• You must be at least 16, or have the consent of a parent or guardian where the law of your country allows a younger age.
• An account is for one person. Keep your device and Apple ID secure — anyone using your signed-in app can spend your credits.
• You can delete your account at any time in the app: tap the credits badge at the top of the camera screen to open Account, then Delete account. Deleting it removes your remaining credits and does not cancel an Apple subscription.

4. Credits

What credits are for

The Captions button shows the cost before you start. Credits are taken when a request is accepted. If the provider cannot process it, the credits are given back automatically.

Free credits

Each new account receives 2 free credits once (2 minutes of captions). They are bound to your Apple account: reinstalling the app, changing device, or deleting and re-creating the account does not give new free credits. Creating several accounts to collect free credits is not allowed.

Rules for all credits

• Purchased credits do not expire while your account exists. Credits added with Premium also stay after Premium ends.
• Credits have no cash value, cannot be exchanged for money, sold, or transferred to another account, and can only be used in Xheki.
• Credits are non-refundable, except where the law requires otherwise. This does not affect your statutory rights or refunds Apple grants (section 6).
• If Apple refunds a purchase, we remove the credits or Premium it gave, as far as they are still available.
• At very busy times the AI features may briefly answer "busy, try again later". No credits are taken in that case.

5. Premium subscription

• What you get: every Premium feature (Dual camera, Screen mode, overlays and pictures including the Pexels stock-photo search, AI thumbnails, teleprompter, Adjust) and 20 credits for each paid week (20 minutes of captions), added when Apple confirms the purchase or renewal.
• Account: Premium works without a Xheki account. The weekly credits go to the account you are signed in with: for the current week once you sign in, and for every renewal after that. Weeks that ended before you signed in, and free trial or free offer periods, bring no weekly credits.
• Price and period: the weekly price is shown in the app and on the App Store before you buy, in your local currency.
• Automatic renewal: payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically each week unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
• Cancelling: in iOS Settings → your name → Subscriptions. Premium features stay on until the end of the period you have paid for. Deleting the app or your Xheki account does not cancel the subscription.
• Price changes are handled by Apple, which informs you and, where required, asks for your consent before a higher price applies.
• Restore: sign in with the same Apple ID and tap Restore Purchases to get Premium on a new device.

6. Purchases through Apple

All purchases are made through Apple's App Store, and Apple's Media Services Terms apply to the payment. Refund requests, and any statutory right of withdrawal you have as a consumer in the EU, are handled by Apple at reportaproblem.apple.com. By buying credits or Premium you ask for the digital content to be delivered immediately; where the law allows, this means the right of withdrawal ends once the content has been delivered.

7. Fair use and limits

To keep the service working for everyone and to protect the shared AI budget, we apply automatic limits. Currently, per account:

• up to 3 requests that use credits per 5 minutes;
• up to 30 free AI requests (spelling pass, post text) per 5 minutes and 300 per day;
• size limits on uploads and requests.

When you reach a limit the app asks you to wait and try again; nothing is charged. We may adjust these limits to protect the service; they will stay reasonable for normal creative use.

8. Acceptable use

You must not use Xheki to:

• create or share content that is illegal, sexually exploits minors, harasses, threatens or incites hatred or violence;
• infringe copyright, trademark, privacy or personality rights of others, or record people where they have not agreed and the law requires consent;
• impersonate someone or create misleading "deepfake" material presenting a real person saying or doing something they did not;
• get around credits, limits, Premium checks or security, reuse or share sessions, or collect free credits with multiple accounts;
• access our server other than through the app, automate or script requests, resell or wrap the service, or use it to build a competing product;
• reverse engineer the app or server, except where the law expressly allows it;
• overload, disrupt or probe the service.

You must also follow the usage policies of the AI providers we use for content you send through the app.

9. Your content and rights

• You own your videos, audio, captions and texts. We claim no ownership of them.
• You allow us to transmit your content to the AI providers and process it only as needed to perform the feature you ask for. This permission ends when the request is complete. We do not use your content to train AI models and do not publish it.
• You are responsible for having the rights to everything you record, import and add — including music, footage and pictures. Stock photos from Pexels are free to use under the Pexels licence, which among other things does not allow showing identifiable people in an offensive way, suggesting that people or brands in a photo endorse you, or selling unaltered copies. Pictures from other sources may need a licence or the owner's permission before you publish them.
• You are responsible for what you publish and where you publish it.

10. AI output

Captions, spelling rewrites, post texts, hashtags, headlines and AI thumbnails are produced automatically by third-party AI systems. They can be inaccurate or incomplete: words may be misheard, spelling changed, meaning shifted, and an AI thumbnail may alter how people or backgrounds look. Transcription works best for clear speech in a supported language and less well with heavy noise, music or mixed languages. A style description you paste in "Make captions sound like you" only guides the wording; it cannot guarantee the result. Review AI output before you publish it. AI output is not advice of any kind. As far as we hold any rights in AI output created for you, you may use it freely; similar output may be produced for other users.

11. Third-party services

Xheki relies on Apple (sign-in and payments), a speech-recognition service (Albanian transcription), OpenAI (transcription of other languages, AI text and images), Pexels (stock photos) and Cloudflare (hosting). "Make captions sound like you" asks you to use your own ChatGPT account; that use is between you and OpenAI. The picture search shows stock photos from Pexels; the Pexels licence and terms apply to them. We are not affiliated with or endorsed by TikTok, Instagram, Pexels or any platform you post to; their names belong to their owners.

12. Availability and changes

We work to keep Xheki available but cannot guarantee uninterrupted service; AI providers and networks can fail. We may improve, change or remove features. If we remove a paid Premium feature, you keep it for the period already paid for or get a fair alternative. We will give reasonable notice in the app before shutting down the service; credits cannot be paid out, so we will not sell credit packs in the last 30 days before a shutdown.

13. Suspension and termination

You can stop using Xheki and delete your account at any time. We may limit or suspend an account that seriously or repeatedly breaks these terms, for example abuse of free credits or limits, or illegal content. Where reasonable we warn you first and let you respond. If we close your account without a breach on your side, we will make a reasonable arrangement for purchased credits you have not used, as required by law.

14. Liability

• We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under product liability law, and where we have given a guarantee.
• For slight negligence we are liable only if we breach an essential obligation (one that makes the service possible and on which you may rely), and then only for the typical damage that could be foreseen when the contract was made.
• Otherwise our liability is excluded. This also applies to our staff and agents.
• Projects and recordings are stored on your iPhone. Keep copies of anything important by exporting it; we cannot restore content on your device.
• Nothing in these terms limits your mandatory rights as a consumer.

15. App Store terms

If you got Xheki from Apple's App Store:

• These terms are between you and MIK Group GmbH only, not Apple. We, not Apple, are solely responsible for the app and its content.
• Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the app, such as your mobile data contract.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Governing law and disputes

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts there. For businesses, the courts of Zürich, Switzerland have jurisdiction.

We do not take part in dispute resolution proceedings before a consumer arbitration board.

17. Changes to these terms

We may update these terms, for example for new features or legal changes. We will announce material changes in the app at least 30 days before they apply. If you do not agree, you can stop using Xheki and delete your account before the change applies; an Apple subscription can be cancelled at any time. Changes never take away credits you already have.
